Procedure to Register DOT OSP
It involves BPO/Call Centers, e-commerce, telebanking, telemedicine, education and other IT enabled services. Department of Telecommunication under the New Telecom Policy (NTP) 1999 made it compulsory OSPs using telecom resources to obtain license.
Procedure to obtain DOT License

No, Partnership Firm can obtain DOT OSP License. Only a Private Limited company registered under Companies Act’20013 and One Person Company (OPC) registered under Companies Act’2013 can apply for DOT OSP license. Apart from these, Limited Liability Partnership (LLP) registered under LLP Act’2008 can apply for DOT OSP License.
No, Proprietorship Firm can obtain DOT OSP License. Only a Private Limited company registered under Companies Act’20013 and One Person Company (OPC) registered under Companies Act’2013 can apply for DOT OSP license. Apart from these, Limited Liability Partnership (LLP) registered under LLP Act’2008 can apply for DOT OSP License.
Registration is granted to any company registered under “Indian Companies Act†including
foreign companies permitted by RBI under the Foreign Exchange Management Regulations
and registered under Part XI (Section 591 to 608) of the Companies Act, 1956 for setting up a
place of business in India.
o Registration is granted to any Limited Liability Partnership(LLP)registered under Limited
Liability Partnership Act 2008.
o OSPs will not infringe on the jurisdiction of other Authorised Telecom Service Providers and
shall not provide switched telephony.
The OSP shall take the Telecom Resources from an Authorised Telecom Service Provider
only. The resources could be based on the technologies like IPLC/MPLS/ATM/FR etc. as
authorised to the authorised telecom service provider having valid licence under Indian
Telegraph Act, 1885.
o Interconnectivity of the International OSP with Domestic OSP is not permitted.
Registration may be granted to any firms registered under Limited Liability Partnership Act
2008 and company registered under the Companies Act 1956, Companies Act 2013,
including foreign companies permitted by RBI under the Foreign Exchange Management
Regulations and registered under Part XI (Section 591 to 608) of the Companies Act, 1956 for
setting up a place of business in India to provide Application Services.
‘Domestic OSP’ means the OSP providing the Application Services within national
boundaries
‘International OSP’ means the OSP providing the Application Services beyond national
boundaries.

‘OSP Centre’ means the infrastructure at a location in India used by the OSP for providing
the Application Services.
‘Applications Services’ means providing services like tele-banking, tele-medicine, teleeducation, tele-trading, e-commerce, call centre, network operation centre and other IT
Enabled Services, by using Telecom Resources provided by Authorised Telecom Service
Providers.
‘Other Service Provider’ (OSP) means a company providing Application Services.
Once annual return is submitted and status is validated, operational OSP's are put in the active list.
OSP without obtaining prior written consent of authority cannot transfer or assign registration to third-party either directly or indirectly.
Also, OSP’s cannot enter into an agreement for sub-leasing and/or partnership of registration with third-party wholly or partly without obtaining consent.
Yes, if the authority finds that there is any non-compliance with the terms and conditions of the registration agreement, OSP registration can be terminated.
Yes, OSP can surrender the registration by giving notice to the authority.
Yes, OSP registration can be suspended by the authority if it is necessary to do so in the interest of public or state.
If annual return is not submitted for continuous 3 years, registration of OSP will be cancelled after keeping them in dormant list for 2 years.
OSP has to submit a copy of OSP Registration of the first site and Certificate of Incorporation if a request is made within one year and there is no change in the status of documents previously submitted.
OSP Registration Compliance The OSP shall submit annual return within six months from the end of the financial year, mentioning the details of the activities performed and the present status of the OSP.
OSPs must comply with the Terms and Conditions prescribed by the Telecom Regulatory Authority of India (TRAI).
The registration is provided on the basis of location, so a company can have more than one registration.
For multiple registrations, the OSP can apply to TRAI for other locations after getting the registration certificate for the first location.
Yes, the validity of the registration can be extended by 10 years on a request of OSP if made during the 19th year of the registration period. The decision of the Authority will be considered final regarding the grant of extension.
OSP registration shall be valid for 20 years from the date of issue unless otherwise mentioned in the registration letter.
